Dowler family urge government not to change ‘no-win, no-fee’ system

The family of murdered schoolgirl Milly Dowler have written to David Cameron stating that the proposed changes to the ‘no win, no fee’ system would have prevented them from taking legal action against News International and have asked the prime minister not to proceed with the planned changes.

If you have had an accident and make a claim for loss of earnings but you have avoided tax in the past - how should the Court deal with your claim?
By avoiding income tax and National Insurance your earnings have been derived by unlawful or illegal means but this will not invalidate your claim for personal injury entirely.

Criminal Injury Compensation Act (CICA) claims can be made by individuals without the need for a solicitor or other formal legal representation. In such cases you keep all of the award – so why instruct a solicitor?
Anyone can of course obtain the basic information for a claim e.g. from the police, witnesses and your GP but it is often important to present this in the correct way to the CICA.

No Win No Fee arrangements or Conditional Fee Arrangements ( CFAs) as they are formally known, ensure that if you do not win your accident claim, you do not have to pay your solicitor a fee. Insurance will also cover you against the risk that you may be required to pay the other side's costs and expenses if you lose.
