Why are lawyers not worried about the growth of DIY legal forms?

Will-writing to become fully regulated

For the first time in the UK, writing a will is to be fully regulated after the Legal Services Board found that some firms were offering an “unacceptable service for customers”, the Telegraph is reporting.

Unfair sale practices, fraud and deception are blighting the will-writing industry, the Legal Service Board - which regulates lawyers – has alleged and in recent evidence it found that a small number of firms were simply “not listening” to their clients.

Are your Trustees equipped to deal with the duties and responsibilities placed on them?

Trusts can offer great flexibility. They allow property to be ring-fenced; placing it in the hands of trustees who have wide powers to deal with it for the benefit of the named beneficiaries. They can be used to mitigate tax and to protect assets from third parties who might have claims over it. In most cases such trusts function perfectly, with the trustees fulfilling their obligations to the satisfaction of the beneficiaries in whose benefit they act.

Will writing firm dumps wills in the street

 

More than 1,000 files containing wills and other confidential information were recently found dumped on the pavement outside a will-writing company in Doncaster, the Society of Will Writers (SWW) revealed this week.

Successful Appeal by adult daughter excluded from late mother's will

The Court of Appeal has upheld the appeal of Mrs Ilott (aged 50 and an only child) against a decision of the High Court that her estranged mother's will could reasonably make no financial provision for Mrs Ilott, instead leaving the entire £486,000 estate to three separate charities. The Court of Appeal directed that Mrs Ilott's appeal against the first instance decision of DJ Million (as he then was) to award her a lump sum of £50,000 from her late mother's estate be remitted to the High Court.
