Code For Home Builders Scheme

 

The Code for Home Builders Scheme (the Code) came into force on 1 April 2010 and applies in England, Wales and Scotland. It affects all residential builders using the major Home Warranty providers and is compulsory for anyone using these schemes.

Opposition to Lease Renewal – Redevelopment Ground

Commercial landlords looking to oppose the renewal of a commercial lease which has the protection of the Landlord and Tenant Act 1954 ('LTA 1954') on redevelopment grounds should take note of a recent Court of Appeal decision of Inclusive Technology v Williamson.  In this case the tenant was awarded additional compensation arising from the landlord's misrepresentation that he intended to redevelop the property and then changed this mind.

Impact of VAT rate reduction to 15%

 The Chancellor has reduced the standard rate of VAT from 17½% to 15% for supplies treated as made after 1 December 2008 until 31 December 2009, after which it will revert to the current rate again.  Zero rated supplies and supplies at the reduced rate of 5% are unaffected.  Anti-avoidance rules will be put in place to prevent businesses artificially accelerating the time of supply any time before the end of 2009, to take advantage of the 15% rate.
